Terms & Conditions

These Terms & Conditions apply to purchases made from Drexel Scuba and Swimwear LLC, including ready-to-ship merchandise and custom-made wetsuits and semi-dry suits. By placing an order, you agree to the terms applicable to your purchase.

Custom Order Agreement

Custom-Fitted Products

Our custom wetsuits and semi-dry suits are individually produced using customer-specific measurements, specifications, colors, design selections, and approved customization details.

By placing a custom order, the customer agrees to participate in the measurement, design, fitting, and approval process as required and to provide complete and accurate information.

Customer Measurements

Customers are responsible for providing accurate measurements when measurements are self-submitted.

If measurements appear inconsistent or require clarification, Drexel Scuba and Swimwear may request that measurements be retaken or verified before production begins.

Production may be delayed until all required measurements and information have been received and accepted.

Design & Specification Approval

Before production begins, customers may be asked to review and approve applicable measurements, colors, design selections, logos, placement details, and other custom specifications.

The customer is responsible for reviewing approval materials carefully and notifying Drexel Scuba and Swimwear of any requested corrections before production begins.

Once a custom order enters production, changes may not be possible. If a requested change can be accommodated after production has begun, additional production costs and additional time may apply.

Production Timeline

Custom wetsuit production typically takes an estimated 6–8 weeks after all required measurements, specifications, design details, and approvals have been finalized.

The 6–8 week production timeframe is an estimate only and is not a guaranteed completion or delivery date.

Production may take longer than 8 weeks due to material availability, production requirements, tailoring or fit adjustments, design complexity, quality-control review, customer-requested changes, communication delays, or other circumstances affecting custom manufacturing.

Delays in submitting measurements, approving designs, responding to requests for information, or completing other required steps will extend the production timeline.

Travel & Event Timelines

Customers should not schedule travel, flights, dive trips, competitions, photo shoots, vacations, or other fixed-date events based upon an estimated production or delivery date.

Production and shipping estimates do not constitute a guarantee that a custom garment will be completed or delivered by a particular date.

Drexel Scuba and Swimwear is not responsible for travel expenses, event expenses, missed trips, missed events, or other consequential costs arising because an order was not completed or delivered by an estimated date.

A delay associated with a customer's personal travel or event schedule does not, by itself, qualify a custom order for cancellation, refund, financial compensation, or complimentary expedited shipping.

Customers requiring a garment for a particular date should contact us before ordering to discuss whether the requested timeframe may be feasible. Discussions concerning feasibility or estimated timing do not constitute a guaranteed completion or delivery date unless expressly agreed to in writing by Drexel Scuba and Swimwear.

Custom Orders Are Final Sale

Because custom wetsuits and semi-dry suits are produced specifically for an individual customer, custom orders are final sale once production begins.

After production begins, an order generally cannot be canceled, refunded, or materially changed due to change of mind, personal preference, scheduling conflicts, travel plans, or customer-provided measurement errors.

This provision does not limit any remedies that may be available for a verified manufacturing defect or a garment that does not conform to the approved specifications, as described in our Shipping, Returns & Refund Policy.

Intellectual Property & Custom Logos

Drexel Scuba and Swimwear Intellectual Property

Unless otherwise stated, original product designs, graphics, photographs, website content, branding, logos, marketing materials, and other original creative materials created or owned by Drexel Scuba and Swimwear LLC remain the intellectual property of Drexel Scuba and Swimwear LLC.

Purchase of a product does not transfer ownership of Drexel Scuba and Swimwear intellectual property to the customer.

Customer-Provided Logos & Artwork

Customers may request the addition of approved logos, names, graphics, or other artwork to certain custom products.

By submitting a logo, trademark, graphic, name, or other artwork for use on a custom product, the customer represents and warrants that they:

  • own the submitted material; or
  • have obtained all necessary authorization, licenses, or permissions required for Drexel Scuba and Swimwear to reproduce and apply the material to the ordered product.

The customer grants Drexel Scuba and Swimwear a limited license to reproduce and use the submitted material solely as necessary to manufacture and fulfill the customer's order.

Ownership of customer-provided intellectual property remains with the customer or its lawful owner.

Drexel Scuba and Swimwear reserves the right to refuse any logo, graphic, trademark, or other material when we reasonably believe its use may infringe the rights of another party or otherwise be inappropriate for production.

The customer is responsible for claims arising from unauthorized use of intellectual property that the customer supplied or instructed Drexel Scuba and Swimwear to reproduce.

Pricing & Payment

Pricing

Product prices are displayed at the time of purchase and may be changed at any time for future orders.

Custom options—including specialized designs, additional logos, pockets, hoods, materials, modifications, or other upgrades—may result in additional charges.

Any additional charges applicable to a custom order will be communicated before the applicable additional work is authorized whenever reasonably practicable.

Payment

Unless otherwise expressly agreed in writing, payment in full is required before production of a custom order begins.

An order is not considered ready for production until required payment, measurements, specifications, approvals, and other requested information have been received.

Shipping

Drexel Scuba and Swimwear currently fulfills and ships orders within the United States only.

Orders will be shipped to the delivery address provided by the customer at checkout. Customers are responsible for reviewing their shipping information for accuracy before submitting an order.

Customers should notify us as soon as possible if they discover an address error. Once an order has been transferred to the shipping carrier, we may be unable to change the delivery address.

Shipping, processing, and production dates are estimates and may be affected by carrier delays, weather, holidays, peak shipping periods, production delays, or circumstances outside of our reasonable control.

Tracking information will be provided when available.

If a carrier confirms that a package has been delivered but the customer cannot locate it, the customer should contact both the carrier and Drexel Scuba and Swimwear promptly so that available delivery information or claim options can be reviewed.

Additional shipping terms are provided in our Shipping, Returns & Refund Policy, which is incorporated into these Terms & Conditions.

Product Use & Diving Risk

Scuba diving, freediving, snorkeling, swimming, boating, and other water-related activities involve inherent and potentially serious risks, including the risk of injury or death.

Wetsuits, semi-dry suits, swimwear, and other equipment sold by Drexel Scuba and Swimwear are not substitutes for proper training, certification, experience, supervision, judgment, or adherence to accepted diving and water-safety practices.

Customers are responsible for determining whether a product is appropriate for their intended activity, environmental conditions, training level, certification, physical condition, and equipment configuration.

Customers should inspect equipment before use and should not use a product that appears damaged, improperly fitted, compromised, or otherwise unsafe.

By choosing to participate in diving or other water-related activities, the user voluntarily assumes the risks inherent in those activities.

To the fullest extent permitted by applicable law, Drexel Scuba and Swimwear LLC is not responsible for injuries, losses, or damages resulting solely from the inherent risks of diving or water-related activities, misuse of a product, failure to follow applicable training or safety practices, unauthorized product modification, or use of a product for a purpose for which it was not designed.

Nothing in these Terms & Conditions is intended to waive or limit any liability or consumer right that cannot lawfully be waived or limited.

Product Variations

Because many of our products are handcrafted or custom-manufactured, minor variations may occur between digital mockups, photographs, samples, and finished products.

Colors may also appear differently depending on device displays, lighting, material, neoprene thickness, fabric lots, printing processes, and manufacturing conditions.

Minor variations that do not materially affect the approved design, function, or fit of the product are not considered manufacturing defects.

Privacy & Communications

We collect and use personal information as reasonably necessary to process orders, communicate with customers, manufacture custom products, provide customer service, process payments, arrange shipping, maintain business records, and operate our business.

Information may be provided to service providers that assist us with functions such as ecommerce, payment processing, manufacturing, shipping, communications, analytics, or other business operations.

Personal information is handled in accordance with our applicable Privacy Policy.

Customers placing custom orders agree to receive transactional communications relating to their order, including requests for measurements or approvals, production updates, shipping notifications, and other communications necessary to complete the order.

Transactional communications related to an existing order are separate from optional marketing communications.

Returns, Refunds & Manufacturing Issues

Returns, exchanges, refunds, manufacturing defects, fit concerns, shipping charges, final-sale merchandise, and custom-product remedies are governed by our Shipping, Returns & Refund Policy.

If these Terms & Conditions and the Shipping, Returns & Refund Policy address the same issue, they should be read together.

Changes to These Terms

Drexel Scuba and Swimwear may update these Terms & Conditions periodically.

The Terms & Conditions in effect when an order is placed will generally govern that purchase unless a change is required by applicable law or otherwise agreed between the customer and Drexel Scuba and Swimwear.

Severability

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Governing Law

These Terms & Conditions and purchases from Drexel Scuba and Swimwear LLC are governed by applicable federal law and the laws of the state in which Drexel Scuba and Swimwear LLC is organized and operates, without limiting any consumer rights that cannot lawfully be waived.
